Keeper of the Fifth Official Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
1. Sponsor
The Keeper of the Fifth promotion (“Promotion”) is sponsored by Groove Web Marketing, LLC, doing business as Better Late Records, Santa Rosa Beach, Florida (“Sponsor”). Questions may be directed to wes@wesherndonofficial.com.
2. Eligibility
The Promotion is open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years old at the time of entry.
Employees, contractors directly involved in administering the Promotion, members of The Wes Herndon Band, and their immediate family or household members are not eligible. The Promotion is void where prohibited or restricted by law.
3. Promotion Period
The Promotion begins August 9, 2026, at 12:01 a.m. Central Time and ends September 8, 2026, at 11:59 p.m. Central Time (“Promotion Period”).
Sponsor’s computer is the official timekeeping device for the Promotion.
4. How to Enter
There are two methods of entry:
Entry with a qualifying preorder
During the Promotion Period, an eligible person who completes a qualifying Better Late second-pressing vinyl preorder through the Better Late Records Shopify store will automatically receive one entry.
The number of products ordered, the amount spent, and the product level selected do not increase the entrant’s chances of winning.
If Sponsor later refunds an order because the proposed second pressing does not move forward, that refund will not invalidate an otherwise eligible entry. Fraudulent orders, unauthorized transactions, and chargebacks may be disqualified.
Free online entry
To enter without making a purchase, complete and submit the free Keeper of the Fifth entry form during the Promotion Period:
https://better-late-records.myshopify.com/pages/keeper-of-the-fifth-entry
The free entry form requires the entrant’s first and last name, email address, state of residence, and eligibility confirmation. Marketing consent is optional and is not required to enter.
5. Entry Limit
Limit one entry per person for the entire Promotion, regardless of entry method.
Making a purchase and submitting the free entry form will not create two entries. Duplicate entries may be identified using the entrant’s name, email address, order information, form submission information, or other reasonably available information and will be consolidated or removed before the drawing.
Automated, robotic, scripted, bulk, fraudulent, incomplete, or otherwise manipulated entries are prohibited and may be disqualified.
6. Random Drawing and Odds
On or about September 10, 2026, Sponsor will conduct a random computerized drawing from all eligible entries received during the Promotion Period.
One potential winner will be selected. The odds of winning depend on the total number of eligible entries received.
Sponsor’s decisions concerning eligibility, duplicate entries, administration of the Promotion, and selection of the potential winner are final.
7. Prize
One winner will receive:
-
One original Better Late test pressing—the fifth of five manufactured
-
The test pressing presented in its original condition
-
A serialized Certificate of Authenticity signed by Wes Herndon
-
Standard shipping to a valid address within the United States or District of Columbia
The approximate retail value of the prize is $250.
The prize is nontransferable before award and may not be redeemed for cash. No prize substitution is permitted except at Sponsor’s discretion if circumstances beyond Sponsor’s reasonable control make the advertised prize unavailable. Any substitute prize will have an equal or greater approximate retail value.
The prize is awarded as-is without warranties beyond those required by law. The winner is responsible for any federal, state, or local taxes associated with accepting the prize.
8. Winner Notification and Verification
The potential winner will be notified using the email address associated with the selected entry.
The potential winner must respond within 72 hours and may be required to:
-
Confirm eligibility
-
Provide a valid U.S. or District of Columbia shipping address
-
Confirm acceptance of the prize
-
Complete an eligibility declaration, liability release, publicity release, or other reasonable verification documents
If the potential winner cannot be contacted, fails to respond within 72 hours, is found ineligible, declines the prize, or fails to provide requested verification, the potential winner may be disqualified and Sponsor may select an alternate potential winner by random drawing.
The potential winner is not considered the official winner until eligibility has been verified and Sponsor confirms the award.
9. Publicity
Except where prohibited by law, acceptance of the prize grants Sponsor permission to announce the winner’s name, city, and state and to use the winner’s submitted statements, photograph, voice, or likeness for reasonable promotional purposes related to the Promotion without additional compensation.
10. Privacy
Information submitted through the free entry form or provided through a qualifying order will be used to administer the Promotion, verify eligibility, contact the potential winner, award the prize, prevent duplicate or fraudulent entries, and comply with applicable legal obligations.
Entrants who separately select the optional marketing-consent checkbox may also receive marketing communications from Better Late Records. Marketing consent is not required to enter and does not affect the odds of winning.
Information will be handled according to the Better Late Records Privacy Policy:
https://better-late-records.myshopify.com/policies/privacy-policy
11. General Conditions
Sponsor reserves the right to disqualify any person who tampers with the entry process, attempts to obtain additional entries, provides false information, interferes with the fair administration of the Promotion, or violates these Official Rules.
If fraud, technical failure, unauthorized intervention, platform failure, natural disaster, or another circumstance beyond Sponsor’s reasonable control materially affects the integrity or proper administration of the Promotion, Sponsor may suspend, modify, or terminate the Promotion. If practicable, Sponsor will select the winner from eligible entries received before the affected time.
Sponsor will not arbitrarily reject an eligible entry and will award the advertised prize in accordance with these Official Rules.
12. Release and Limitation of Liability
To the fullest extent permitted by law, entrants release Sponsor, The Wes Herndon Band, and their respective owners, members, employees, contractors, representatives, and agents from claims arising from participation in the Promotion or the acceptance, possession, use, misuse, loss, or damage of the prize.
Sponsor is not responsible for late, lost, incomplete, inaccurate, misdirected, corrupted, or undeliverable entries or communications caused by technical failures, internet interruptions, email filtering, incorrect information supplied by an entrant, or circumstances outside Sponsor’s reasonable control.
Nothing in these Official Rules limits liability that cannot legally be limited or excluded.
13. Disputes and Governing Law
The Promotion and these Official Rules are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent permitted by law, disputes arising from the Promotion shall be resolved individually and not through a class action. Any legal proceeding shall be brought in an appropriate state or federal court located in or serving Walton County, Florida.
14. Social-Media Disclaimer
This Promotion is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, TikTok, YouTube, X, Shopify, or any other social-media or commerce platform used to communicate or administer the Promotion.
By entering, each entrant releases those platforms from claims arising from the Promotion.
15. Winner Information
After the winner has been confirmed, requests for the winner’s name, city, and state may be sent to wes@wesherndonofficial.com with the subject line “Keeper of the Fifth Winner Request.”
Requests must be received by December 31, 2026.
